with the 4ComTech Affiliate Program as well as other services ("Services")
which may or may not be hosted on the 4ComTech website. By signing up for the 4ComTech
Affiliate Program, you agree to all of the rules stated in the
terms and conditions. All of the following
terms and conditions must be adhered to and are legally binding immediately upon
agreement. 4ComTech.com reserves the right to terminate or modify this agreement
at their sole discretion.

Affiliates
* Webmasters who join 4ComTech as an 'Affiliate' are paid solely by 4ComTech.
All money earned will be tracked by a in house script developed by a 3rd party
client. Any
affiliate found to substantially alter 4ComTech affiliate code or intentionally
defraud the affiliate program through the use of automated, human,
technological, or other means to falsely generate leads, clicks, downloads, or
installations, will be immediately removed from the program and will forfeit all
pending funds earned. Any affiliate found to intentionally defraud the affiliate
program through the use of automated, human, technological, or other means to
falsely generate leads, clicks, downloads, or installations may be persecuted to
the fullest extent of the law. 4ComTech reserves the right to alter the
pay rate or discontinue this program at any time without prior notice. If 4ComTech
discontinues program, affiliate understands that all outstanding monies
not earned will be forfeited. It is up to the affiliate to check this site
for details.
* Affiliate is paid $0.03USD per unique
installation of any of
4ComTech Browsers.
Installations and IP addresses are tracked, thus one installation per user will
be counted. If end user downloads several of our 4ComTech browsers, only
one installation will be credited.
* Affiliates who live in the United States of
America may choose check or paypal for payment method. Foreign affiliates
understand that Paypal will be the only method available for payment.
Webmasters who do not have a Paypal account may sign up here.
* Minimum
earnings to receive a check is $10.00. Our pay periods run
from the 1st to the end of month. Checks are mailed monthly (payment
schedule). If you do not earn
$10.00 in any single
pay period your earnings will "roll-over" to subsequent periods until you
accumulate $10.00.
Once affiliate signs up to the program $3.00 USD is credited to affiliates' account.
The $3.00 sign up bonus credited to your account, will only
be paid to affiliate when affiliate reaches minimum earnings. A valid USA social security number must be provided for all
payments made to USA addresses after affiliate reaches $600.00USD. We cross reference all SSN's
to the "payable to" name on the account. Payments will not be mailed until this
requirement is properly satisfied.
* 4ComTech reserves the right to terminate
affiliate's
account if the account is idle for more than three months.
* 4ComTech reserves the right to terminate
affiliate's account if the affiliate doesn't accumulate one installation upon 30
days after signing up.
* DO NOT SPAM
IN ANY WAY! We detect
and discard all traffic from e-mail, newsgroups, ICQ and all other methods other
than a click on a web page. Spamming by any of these methods is pointless, the
installations will be discarded, and your account will be terminated. We have
excellent tools developed to seek fraudulent activities. In other words if
your thinking about cheating, don't. We will prosecute to the fullest
extent of the law.
*Only one account is allowed per company or organization. You may use this
account for as many domains and/or websites as you wish.
* Note: Affiliate will not earn
credit if the affiliate installs a web browser by using his/her own affiliate
URL
* It is against the rules to artificially
generate installations, downloads, clicks in any way. All downloads must be the product of
a surfer clicking on your affiliate download link on a web page. Installations from e-mail, newsgroups,
javascripts, refresh scripts, redirect scripts or
type-ins automatically get discarded. 4ComTech.com has no obligation to pay affiliate for commissions for
installations that were not
generated by means of a valid download which shall be determined in 4ComTech sole
discretion.
* We do not allow incentivised clicks or
downloads of any kind.
* 4ComTech.com reserves the right to
terminate an affiliates account at 4ComTech's sole discretion.
*
Each page that contains a 4ComTech.com link must be part of a regularly viewed
web page that is regularly accessed by a surfer during that surfer's visit to
your website(s).
* Without limitation, affiliate's participation
in the 4ComTech affiliate program may be terminated, where 4ComTech, in its sole
discretion, determines: (1) that any content, goods, services, or links
displayed on or made available through or in connection with affiliate's web
site(s) are illegal, obscene, indecent, vulgar, offensive, dangerous, or are
otherwise deemed inappropriate by 4ComTech in its sole discretion; or that
affiliate or affiliate's web site(s) violates, has violated, or threatens to
violate either the letter of these terms and conditions or the spirit behind
them.
* Under no circumstances shall 4ComTech be liable
for any delay or failure in performance under these terms and conditions
resulting directly or indirectly from acts of nature, forces, or causes beyond
its reasonable control, including, without limitation, internet failures,
computer equipment failures, telecommunication equipment failures, other
equipment failures, electrical power failures, strikes, labor disputes, riots,
insurrections, civil disturbances, shortages of labor or materials, fires,
flood, storms, explosions, acts of God, war, governmental actions, orders of
domestic or foreign courts or tribunals, nonperformance of third parties, or
loss of or fluctuations in heat, light, or air conditioning.
* All downloads you send to us must come from a
web page. We do not allow newsgroup postings with links to us. Nor do we allow
e-mail links/ ICQ/ InstantMessage/ spamming or any other such practices that
could reflect negatively on our program. Failure to comply to this request will
result in the immediate cancellation of the account from which the hits were
sent and also may result in the forfeiture of any funds owed to that account.
* The action of sending any hits from any URLs
which contain and/or promote the following content: warez, MP3s, ROMs, EMUs,
newsgroup postings, spam e-mails, or any other site which contains content or
promotes activities which are illegal in the united states without the prior
written consent of 4ComTech will result in the immediate cancellation of the account
from which the hits were sent and the forfeiture of any funds owed to that
account.
* 4ComTech reserves the right to terminate the
account of any affiliate who publicly posts derogatory and or slanderous
statements about 4ComTech.com.
* Any artificial means of generating downloads
and installations
including, but not limited to, hitbots, multiple clicking scripts, multiple
downloading scripts, begging for
clicks, zero frames, IRC cheats, incentivizing the surfer in any way or any
other similar activity will result in forfeiture of all monies owed and criminal
prosecution. Downloading the software from your own links to generate money is
strictly forbidden. Affiliate will forfeit all monies an account will be
terminated.
* Non compliance with these terms and conditions
will result in the forfeiture of all monies owed and the possible prosecution of
the cheating webmaster.

Disclaimer of
Warranties
The services are provided "as is," without warranty of any kind. 4ComTech
disclaims any warranties, express or implied, including any warranties of title,
non-infringement, merchantability or fitness for a particular purpose.
Potential Liability for
the Services is Limited
Neither 4ComTech nor any of its officers, directors, agents, subsidiaries,
affiliates, employees, successors, assigns, content providers, or service
providers will be liable to you for any indirect, incidental, special, or
consequential damages arising out of use of the services, or inability to gain
access to or use the services.
4ComTech
and advertisers
will not be liable for any material of web sites it links to as part of the
services or for information contained in or part of the services including but
not limited to search results. Because some states do not allow the exclusion or
limitation of liability for consequential or incidental damages, the above
limitation may not apply to you. In such states, the respective liability of 4ComTech, its employees, agents, successors, assigns, affiliates, and content or
service providers is limited to the greatest extent permitted by such state law.
Amendment of Terms
4ComTech may amend this agreement from time to time as necessary without prior
notice. All amended terms are automatically effective immediately after they are
initially posted. This Agreement may not be otherwise amended except in a
written document signed by you and 4ComTech.
